Who May Adopt

The following persons may adopt:

  • Any unmarried adult
  • The spouse of a legal parent of the child
  • A husband and wife jointly

Who May Be Adopted

Citation: Rev. Stat. §§ 578-1.5; 578-2

Any person may be adopted. An adult may be adopted only if that adult, and his or her spouse if that adult is married, gives written consent to the adoption.

Who May Place a Child for Adoption

A child may be placed by or consent may be given by any of the following:

  • The parent or legal custodian
  • The Department of Human Services
  • An approved child-placing organization
