The term 'abused or neglected child' includes any child younger than age 18 to whom either of the following applies:
- Whose parents or other person responsible for his or her care commits or allows to be committed any act of sexual exploitation or any sexual act upon a child in violation of the law
- Who has been identified as a victim of sex trafficking or severe forms of trafficking, as defined in the Trafficking Victims Protection Act of 2000 (22 U.S.C § 7102, et seq.) and in the Justice for Victims of Trafficking Act of 2015 (42 U.S.C. § 5101, et seq.)

Definitions of Sex Trafficking of Minors
Citation: Ann. Code § 18.2-357.1
Any person who, with the intent to receive money or other valuable thing or to assist another in receiving money or other valuable thing from the earnings of a person from prostitution or unlawful sexual intercourse in violation of § 18.2-346(A), solicits, invites, recruits, encourages, or otherwise causes or attempts to cause a person to violate § 18.2-346(A) is guilty of a Class 5 felony.
Any person who violates the above subsection through the use of force, intimidation, or deception is guilty of a Class 4 felony. Any adult who violates the above with a person who is younger than age 18 is guilty of a Class 3 felony.
