Physical Abuse
Citation: Tribal Code Tit. 5, § 7-20

'Abuse' means the infliction of physical injury on a child, including failure to maintain reasonable care and exploiting a child to such an extent that their health, moods, or emotional well-being is endangered.

'Child in need of protection' means a child who has been adjudicated to be either of the following: 

  • Who has been physically abused by their parent(s), guardian, or custodian
  • Whose parent(s), guardian, or custodian has knowingly, intentionally, or negligently tortured, cruelly confined, or cruelly punished the child

Neglect
Citation: Tribal Code Tit. 5, § 7-20

'Child in need of protection' means a child who has been adjudicated to be any of the following:

  • Who is in need of proper and effective parental care or control and has no parent, guardian, or custodian able or willing to exercise such care or control
  • Who has not been provided with adequate food, clothing, shelter, medical care, education, or supervision by their parent(s), guardian, or custodian necessary for their health and well-being
  • Whose parent(s), guardian, or custodian has knowingly, intentionally, or negligently placed the child in a situation that may endanger their life or health

Sexual Abuse/Exploitation

The term 'abuse' includes sexual abuse or sexual exploitation of a child.

'Child in need of protection' means a child who has been adjudicated to be either of the following: 

  • Who has been sexually abused by their parent(s), guardian, or custodian
  • Who has been sexually exploited by their parent(s), guardian, or custodian

Emotional Abuse
Citation: Tribal Code Tit. 5, § 7-20

The term 'abuse' includes the infliction of emotional or mental injury on a child.

'Child in need of protection' means a child who has been adjudicated to have been emotionally or psychologically abused by their parent(s), guardian, or custodian.

Abandonment
Citation: Tribal Code Tit. 5, § 7-20

'Abandon' means the failure of the parent, guardian, or custodian to provide reasonable support and maintain regular contact with the child, including providing normal supervision, when such failure is accompanied by an intention on the part of the parent to permit such condition to continue for an indefinite period in the future. Failure to maintain a normal parental relationship with the child without just cause for 6 months shall constitute prima facie evidence of abandonment.

'Child in need of protection' means a child who has been adjudicated to have been abandoned by their parents, guardian, or custodian. 

Standards for Reporting
Citation: Tribal Code Tit. 5, § 7-230

A report is required when any person knows or has reasonable cause to suspect that a child has been abused, neglected, or abandoned. 

Persons Responsible for the Child
Citation: Tribal Code Tit. 5, § 7-20

'Persons responsible for the child' include the child's parent, guardian, or custodian.
