The adoption action shall be commenced by sworn petition filed in the chancery court.
Venue

The adoption petition shall be filed in the county in which one of the following applies:
- Where the adopting petitioner or petitioners reside
- Where the child to be adopted resides, was born, or was found when they were abandoned or deserted
- Where the home to which the child has been surrendered by a person authorized to so do is located
