Right of the Reported Person to Review and Challenge Records

The Division of Child Protection and Permanency in the Department of Children and Families may, upon written request, release the records and reports of child abuse and neglect, or parts thereof, consistent with the provisions of § 9:6-8.83, et al., to any person appealing a department service or status action or a substantiated finding of child abuse or neglect and their attorney or authorized lay representative upon a determination by the department or the presiding administrative law judge that such disclosure is necessary for a determination of the issue on appeal.

When Records Must Be Expunged

The division shall expunge from its records all information relating to a report, complaint, or allegation of an incident of child abuse or neglect when an investigation has determined that the allegation was unfounded.
