Immunity for Making Reports

Anyone reporting any incident of child abuse or neglect pursuant to the reporting laws is immune from any civil or criminal liability that might otherwise be incurred or imposed.

Anyone investigating any incident of child abuse or neglect, participating in resulting judicial proceedings, or furnishing hospital or medical records pursuant to the reporting laws is immune from any civil or criminal liability that might otherwise be incurred or imposed.

Limitations to Immunity

Anyone investigating or reporting an incident of child abuse or neglect pursuant to the reporting laws is immune from any civil or criminal liability that might otherwise be incurred or imposed, unless the person was grossly negligent, acted in bad faith or with malicious purpose, or provided information knowing the information to be false.
