Immunity for Making Reports

Citation: Idaho Code § 16-1606

Any person who has reason to believe that a child has been abused, abandoned, or neglected and who acts upon that belief to make a report of abuse, abandonment, or neglect as required by the reporting laws shall have immunity from any civil or criminal liability that might otherwise be incurred or imposed.

Additional Provisions of Immunity

Any such participant shall have the same immunity with respect to participation in any judicial proceeding resulting from such report.

Limitations to Immunity

Any person who reports in bad faith or with malice shall not be protected by this section.
