Grounds for Termination of Parental Rights
Citation: Tribal Code § 16.04.10
In cases of involuntary termination of parental rights, the Tribe must prove by clear and convincing evidence of each of the following:
- The parent has done any of the following:
- Abused the child physically or sexually
- Abandoned the child
- Chronically neglected the child
- Chronically emotionally maltreated the child
- Termination of the parent's rights and adoption are in the best interests of the child and of the Tribal community.
- The Tribe has offered or helped arrange for appropriate resources to help the parent care appropriately for the child.
- It is unlikely that the parent will be able to care appropriately for the child.
Timeframes for Termination Proceedings

The court may order termination of a parent's rights only when an appropriate adoptive home is available and adoption proceedings have been filed in conjunction with the termination proceedings.
