Physical Abuse
Citation: Tribal Code § 6.10.80

The term 'child in need of protection' refers to the following:

  • A child who has suffered or is likely to suffer significant physical injury as the result of abuse or neglect.
  • A child who is born addicted or exposed to alcohol, a controlled substance, or another other drug harmful to the physical or mental welfare of the child
  • A child who has witnessed domestic violence, and the child's parent, guardian, or custodian failed to eliminate the risk of the child witnessing that domestic violence when that person knew or should have known of the risk

Neglect
Citation: Tribal Code § 6.10.80

The term 'child in need of protection' refers to the following:

  • A child who has not been provided adequate food, clothing, shelter, medical care, education, or care and control by the child's parent, guardian, or custodian, which is necessary for the child's health, safety, or welfare, and the deprivation is not due to the lack of financial resources available to the parent, guardian, or custodian
  • A child who has been placed at an unreasonable risk with respect to the child's health, safety, or welfare by failure of the parent, guardian, or custodian to intervene to eliminate the risk when that person knew or should have known of the risk

Sexual Abuse/Exploitation
Citation: Tribal Code §§ 6.10.30; 6.10.80

'Sexual abuse' means any unwanted, improper, or harmful sexual activity imposed upon an individual by another and includes, but is not limited to, the following:

  • Sexual touching of any part of the body, clothed or unclothed
  • Encouraging a child to engage in sexual activity
  • Intentionally engaging in sexual activity in front of a child
  • Showing a child pornography or using a child to create pornography
  • Any other act deemed sexual and improper or harmful by Children Services or the Tribal Court

The term 'child in need of protection' refers to a child who has been sexually abused or sexually exploited.

Emotional Abuse
Citation: Tribal Code § 6.10.80

The term 'child in need of protection' refers to a child who has suffered or is likely to suffer significant emotional damage as the result of abuse or neglect.

Abandonment
Citation: Tribal Code § 6.10.80

The term 'child in need of protection' refers to a child who has no parent, guardian, or custodian available, willing, and/or capable of caring for the child.

Standards for Reporting
Citation: Tribal Code § 6.10.100

A report is required when a mandatory reporter has reasonable cause to believe that a child has suffered child abuse or neglect.

Persons Responsible for the Child
Citation: Tribal Code § 6.10.80

Persons responsible for the child include the child’s parent, guardian, or custodian.

Exceptions
Citation: Tribal Code § 6.10.80

A child is not a 'child in need of protection' when any deprivation is due to the lack of financial resources available to the parent, guardian, or custodian.
