Jurisdiction

Except when the child involved is subject to the jurisdiction of an Indian Tribe pursuant to the Indian Child Welfare Act, the district courts have original jurisdiction in adoption proceedings.
If proceedings pursuant to this chapter involve the relinquishment of an Indian child who is a ward of a Tribal court, resides on a reservation, or is domiciled on a reservation, the court shall transfer the proceedings to the Indian child's Tribe in accordance with the Indian Child Welfare Act. For the purposes of this section, the domicile of an Indian child must be determined according to Federal common law.
