1 The definition of "child abuse and neglect" from the Child Abuse Prevention and Maltreatment Act (CAPTA):
"The term 'child abuse and neglect' means, at minimum, any recent act or failure to act on the part of a parent or caretaker, which results in death, serious physical or emotional harm, sexual abuse or exploitation, or an act or failure to act which presents an imminent risk of serious harm." 42 U.S.C.A. §5106g(2) (West Supp. 1998) back |
2 The definition of "disability" from the Americans with Disabilities Act (ADA):
The term "disability" means, with respect to an individual -
(A) a physical or mental impairment that substantially limits one or more of the major life activities of such individual;
(B) a record of such an impairment; or
(C) being regarded as having such an impairment. 42 U.S.C. §12102(2) (1999).
The phrase physical or mental impairment includes, but is not limited to, such contagious and noncontagious diseases and conditions as orthopedic, visual, speech, and hearing impairments, cerebral palsy, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, mental retardation, emotional illness, specific learning disabilities, HIV disease (whether symptomatic or asymptomatic), tuberculosis, drug addiction, and alcoholism.
